I am disabled and get social security although I am 56 years old. I depend on electrical devises to function ie. anelectric wheelchair, a hoyer devise to transfer from bed to chair, I have medical issues that require water daily, and I have an electric lift to get out of my house to driveway level. I live in New Hampshire where weather causes me to lose power several times a year. Most times it is for several days. Last year I was without power for 6 days on one occasion and had to stay in bed for days. My doctor has agreed to write a letter of medical necessity for me to have a generator installed. I am also looking to buy a wheelchair van before the end of the year. The wheelchair conversion is deductible as a medical expense. Can I deduct these expenses which are more than 7.5% of my income and is there a limit to how much I can deduct in a year?

Deb,

The Itemized Deduction for Medical Expenses. Many of your medical expenses are tax deductible if you itemize rather than claim the standard deduction. If your total medical expenses exceed 7.5 percent of your adjusted gross income in 2017 and 2018, you can claim a deduction for the balance. The amount of the medical deduction added to all your other Itemized deduction cannot reduced your income below zero and any unused medical expenses cannot be carried over to the next tax year.

Capital Expenses (including whole house generators)

You can include in medical expenses amounts you pay for special equipment installed in a home, or for improvements, if their main purpose is medical care for you, your spouse, or your dependent. The cost of permanent improvements that increase the value of your property may be partly included as a medical expense. The cost of the improvement is reduced by the increase in the value of your property. The difference is a medical expense. If the value of your property isn't increased by the improvement, the entire cost is included as a medical expense.

So does this mean I have to have my house appraised twice? This will cost money also. If my husband and I have an AGI of $120,000, and the van deduction is $30,000 and the generator is $15000 our medical expenses would be about $50K. So we could deduct about $40K? Comment?

Under your face it says you are a technician. I was told my question was being sent to a tax expert and that a technician was not qualified to answer my question.

In NH, we get a fair amount of snow. In order for my visiting nurses and aides to get in my house, or for me to go to a doctor’s appointment about once or twice a month, I need to pay someone to plow my driveway and shovel the walkways. Is this a deductible medical expense? I could not remain in my home if the VNA did not have access. My driveway is about 50yards long and is dirt. I really need to have it graded and some holes filled in so the handicapped van can get in to pick me up. Is upkeep of access to my house deductible?

I posted several clarification questions. Do I need to have an official appraisal done? Are you a tax expert? Is driveway maintenance a medical expense? Will I have to pay another $50 to get these other questions answered.

Deb,

First I am IRS Enrolled Agent and have been a tax professional for over 30 years.

It would be best to have an appraisal done in order to determine the value of your home after the improvement (Generator) was made; so you will be able to determine what, if any, amount is to be included in Medical expenses, Itemized deductions.

Maintenance - any maintenance paid that is related to qualified medical expenses would be deductible.

No additional fee!!
