Pearl Wilson, Lawyer's Assistant Welcome! How can I help with your question? You Hi, I have a tax question about working remotely in WA where I would move to (no income tax) for a company based in Oregon (income tax), yet only traveling to Oregon 12 days a year 1x month for company meetings. How would filing taxes work in that situation, and would my OR company have to deal with those special 12 days at all with their own taxes paying me or would I just do some kind of adjustment on my own taxes if needed? It may not even be needed, just 12 days of income isn't very much at $19-$22 hr.

Welcome to ExpertHelp.  My name is Barbara, I am an IRS Enrolled Agent, and I will be happy to assist you.

Based on the information you provided, the income that would be allocated to Oregon for 12 days per year is less than the income filing threshold for a single individual in Oregon.  If your employer does withhold Oregon state taxes, you will want to file a nonresident state return in Oregon to receive a refund.

Please let me know if I can assist you further.

Thank you and best regards,

Hello,

Thanks for your response. Just to be sure with the base if the question, if I work remotely in WA and live in WA for a company based in Oregon, then the Oregon company, legally, has no obligation to take out income taxes, is that correct?

I understand the 12 days per year wouldn't make up enough to count toward Oregon income tax. I plan on proposing this scenario to them so I want to make sure it's understood first. Thanks for your help.

Employers in Oregon are required to withhold taxes from their employees regardless of where they are located--in Oregon or outside of Oregon unless the employer can prove that the earnings will be less than $300 per calendar year.

Hello,

Thanks, when I search online about WA residents working remotely for OR companies it always says WA residents are only taxed for income earned in Oregon, so if the majority of my income is earned remotely in WA then I don't understand why the Oregon company would need to file income taxes. http://blog.oregonlive.com/finance/2009/12/do_washingtonians_pay_income_t.html Thanks again

The Oregon employer is required to withhold from ANY employee (remote or not) if the earnings are $300 or more for the year.  All you have to do is file an Oregon nonresident return to receive a refund for any portion earned in Washington, which will be the majority of your earnings since you are spending only 12 days per year in Oregon.
